By accessing or using our websites, booking a consultation, or enrolling in any program, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Purchase & Refund Policy. If you do not agree, you must not use our services.

These Terms apply to all websites, subdomains, digital content, email campaigns, online learning platforms, and live or virtual events operated by Pioneers Tutoring & Speech.

1. Services Offered

Pioneers Tutoring & Speech provides:

Online and in-person tutoring and speech pathology services

Initial assessments, parent consultations, and student progress plans

Structured literacy programs including the LSS (Learning Support Specialist) program

NDIS-registered Developmental Therapy services

Workshops, digital educational resources, and sell-paced courses Subscription content, memberships, and related merchandise

We reserve the right to change or discontinue any service at any time with reasonable notice.

2. User Responsibilities

By using our services, you agree to:

Provide accurate and up-to-date account and enrolment information

Secure your login credentials and notify us of any unauthorised access

Obtain the necessary hardware, software, and internet connection for online sessions Pay all applicable fees on time as agreed at enrolment

You must be at least 18 years of age, or have parental or guardian consent, to use our services or enrol a student in our programs.

3. Intellectual Property

All content produced by Pioneers Tutoring & Speech - including lesson materials, assessments, curricula, resources, recordings, logos, and digital tools — remains the exclusive intellectual property of Pioneers Tutoring & Speech.

Access and use materials for the enrolled student's personal educational use only

Download one (1) copy of authorised materials for home use

You may not:

Copy, modify, resell, or redistribute any materials Share materials with other tutors, educators, or third parties

Use our content or branding for commercial purposes without written consent

Record sessions, screen share, or capture content without prior written approval

Unauthorised use or distribution of our intellectual property may result in immediate termination of services and legal action.

4. Payment Terms

All fees must be paid as outlined in your enrolment agreement or at checkout. You agree to:

Pay all fees on time using a valid payment method

Review the terms of any payment plan before signing

Notify us promptly if your billing details change

Pioneers reserves the right to suspend services where fees remain outstanding.

5. Cancellations & Refunds

A Cooling Off Period of 3 business days applies from the date of signing your enrolment agreement.

You may cancel without penalty within this window.

Outside the cooling off period, the following applies:

Session cancellations require a minimum of 24 hours' notice. Late cancellations or no-shows may be charged in full.

• If you choose to discontinue the program before the agreed period, no refund will be issued for remaining prepaid sessions.

Refund requests related to exceptional circumstances (e,g. medical emergencies) will be considered on a case-by-case basis with supporting documentation.

For refund requests outside of the Money-Back Guarantee, please contact us in writing within 24 hours of the relevant session.

6. Money-Back Guarantee

Pioneers Tutoring & Speech offers a conditional Money-Back Guarantee to eligible students enrolled in the LSS (Learning Support Specialist) structured literacy program. This guarantee is subject to strict eligibility criteria and does not constitute an unconditional guarantee of academic results.

Eligibility Conditions

To quality for the Money-Back Guarantee, all of the following must be satisfied:

6.1 The student is enrolled in a program of two (2) or more sessions per week.

6.2 The student is at least six 6) years of age and able to spell three-letter words at program commencement.

6.3 The student attends all scheduled sessions for the full agreed program period. Early cancellation or discontinuation voids the guarantee.

6.4 Any sessions missed due to illness or unforeseen circumstances are rescheduled and completed within the program timeframe.

6.5 The student actively participates in sessions and completes all assigned activities. Parents and guardians support the program by ensuring recommended practice is completed between sessions.

6.6 The student completes the initial assessment and all scheduled progress assessments, conducted under standardised conditions within the program timeframe.

6.7 Parents or guardians maintain reasonable communication with the tutor and attend any requested progress meetings.

Void Conditions

The guarantee is void it:

Sessions are missed without rescheduling within the program period

The student demonstrates persistent refusal to engage, disruptive behaviour, or lack of reasonable participation

Parents or guardians fail to support recommended practice activities

The student receives additional tutoring or external literacy intervention during the program period that may influence results

External factors occur that may reasonably affect progress (e.g, signilicant changes in schooling, home environment, or newty identified learning conditions)

Refund Determination

6.8 A refund will only be considered where no measurable improvement in reading accuracy. spelling, or fiuency Is demonstrated between the student's initial and final assessments, as determined solely by Pioneers Tutoring using our internal assessment methods.

Pioneers Tutoring will assess eligibility based on program adherence and assessment outcomes. Any dispute will be reviewed internally by our senior educational specialist team, whose determination is made in good faith in accordance with this policy.

7. NDIS & Developmental Therapy Services

NDIS-funded Developmental Therapy services are subject to NDIS terms, pricing, and eligibility requirements in addition to these Terms. Families accessing services under NDIS funding acknowledge that:

Services are delivered in accordance with Pioneers NDIS registration obligations

Literacy and learing outcomes achieved during Developmental Therapy sessions are incidental to the therapeutic goals of the program

The Money-Back Guarantee does not apply to NDIS-funded services

8. Limitation of Liability

Pioneers Tutoring & Speech provides educational and therapeutic support services. Individual progress will vary depending on the student's level of engagement, attendance, practice, and other external factors.

To the maximum extent permitted by law:

Pioneers is not liable for indirect, incidental, or consequential loss or damage arising from our services

Pioneers does not guarantee specific academic results, reading levels, or learning outcomes outside of the conditional Money-Back Guarantee described in Section 6

• Total liability is limited to the total fees paid by the client in the twelve 12) weeks preceding the event giving rise to the claim

Nothing in these Terms limits or excludes rights that cannot be excluded under the Australian Consumer Law.

9. Prohibited Conduct

You agree not to:

Impersonate others or misrepresent your identity or affiliation

Use our services for illegal, unethical, or harmful purposes Disrupt, hack, or overload our systems or platforms Solicit staff or other clients for unrelated services

Violations may result in immediate termination of services and legal action.

10. Electronic Communications

By using our services or submitting an enquiry, you consent to receive emails, SMS messages, and digital notices from Pioneers Tutoring & Speech. You may opt out of marketing communications at any time by contacting us or using the unsubscribe link in our emails.

11. Force Majeure

Pioneers shall not be liable for any delay or failure in service delivery caused by events beyond our reasonable control, including natural disasters, pandemics, goverment restrictions, or power or internet outages. In such circumstances, sessions may be rescheduled or delivered in an alternative format without penalty. If disruption continues beyond 30 days, either party may terminate the agreement in writing, with unused prepaid fees credited toward future services.

12. Modifications

We may update these Terms at any time. Changes will be reflected on this page with an updated date. Continued use of our services following any update constitutes acceptance of the revised Terms.

13. Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You agree to the exclusive jurisdiction of courts in Victoria for any dispute arising under these Terms.
